Domestic Abuse and Harassment

If you are being abused or harassed by a spouse or partner, then you can apply to the Court for Protective Orders.

Domestic abuse is where one person causes harm or distress to their partner or ex-partner. It can take the form of physical violence, mental, verbal, or even sexual abuse.

A victim should, in the first instance, report the offending behaviour to the police. However, the Court also provides protective remedies in the form of Interdict, Exclusion and Non-Harassment Orders, which can be granted by the local Sheriff Court.

The Sheriff will grant Orders if he or she is satisfied that they are reasonably necessary for a victim’s safety, or that of any children.

We have unrivalled experience of dealing with domestic violence cases, dating back to 1985, when such protective orders were first introduced by the Matrimonial Homes (Family Protection) (Scotland) Act 1985. Indeed, we secured some of the very first orders granted by Courts in Scotland.
